claiming they used the song "Lose Yourself" without his
permission. He is claiming copyright infringement over a
commercial that aired on MTV last year for Apple iTunes. The
commercial featured a boy playing an iPod and sining along
to "Lose Yourself".
The lawsuit says, "At no time did Apple, Chiat/Day or MTV
receive authorization or permission to record, reproduce,
perform, transmit, copy, use or otherwise exploit the
composition for any purpose." It also saidm "Defendants have
acted intentionally, recklessly, willfully and in bad
faith."
The amount Eminem is seeking in damages was not revealed
though, according to the BBC, the lawsuit went on to say
that Eminem has never endorsed any product, but if he did it
would be for in excess of $10m.
2-25-04: Rap superstar
Eminem cut a wide and memorable swath through Las Vegas on
Monday. During a meeting at the V Bar at The Venetian on
Monday afternoon, he gave an impromptu mini-concert,
including new songs, that was aired over the casino's sound
system, attracting a huge crowd to the bar. Later, he
performed at a ballroom in The Venetian to promote his Slim
Shady clothing line as part of the MAGIC convention this
week. Then it was off to the Palms, where he was greeted by
500 fans and employees when he stepped out of the limo at
2:45 a.m. With his entourage and an MTV documentary camera
crew, the rapper tried his hand at bartending at ghostbar,
climbing on the bar at one point to announce, "Free drinks
on the house!" Maloof got stuck with a sizeable tab, "but it
was well worth it. This was right up there with the Britney
(Spears) concert," he said.
2-12-04:
MOUNT CLEMENS, Mich. (AP) — Hip-hop
superstar Eminem's ex-wife was sentenced to serve at least a
month in jail Thursday for using cocaine while on probation.
Circuit Judge Edward Servitto ordered Kimberly Mathers to
serve 30 days in the Macomb County Jail and then be
transferred to an inpatient substance abuse treatment
program for an additional 90 days. Mathers admitted a week
ago to her probation agent that she was using cocaine, the
Michigan Department of Corrections has said.
Mathers tested positive for cocaine after being given a
urine test during a Jan. 29 meeting with the probation
agent. She missed a scheduled meeting last week but later
met with the agent and admitted using cocaine, the
corrections department said.
Mathers was sentenced on Jan. 21 to two years' probation
after pleading guilty to charges of possessing 25 grams or
less of cocaine and failing to give adequate space to an
emergency vehicle. The charges stemmed from a June traffic
stop in St. Clair Shores.
Among other conditions of her probation, Mathers was barred
from using alcohol or nonprescription drugs and ordered to
undergo random drug testing. Defense attorney Michael
Sinutko did not immediately return a telephone message left
Thursday morning at his office.
Mathers and Eminem, whose legal name is Marshall Bruce
Mathers III, have a daughter, Hailie Jade Mathers. |
